Microsoft sued over alleged Xbox 360 glitch

LOS ANGELES (Reuters) - A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp. and Nintendo Co Ltd. that it sold a "defectively designed" product.

Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.

Microsoft spokeswoman Molly O'Donnell on Monday said the company does not comment on pending litigation.

Complaints about the problem surfaced quickly on gaming enthusiast Web sites after the Xbox 360 debuted on November 22.

Console owners reported that some systems had crashed during regular use as well as during online game play using the Xbox Live service. Problems included screens going black and the appearance of a variety of error messages.

At the time O'Donnell told Reuters: "We have received a few isolated reports of consoles not working as expected."

She declined to say how many reports Microsoft had received and said that calls reporting the issue to the company represented a "very, very small fraction" of units sold.

The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.

I just read that 10 minutes ago. It's very unlikely that the the Chicago dude will win.

WTB tomorrow a store here is going to sell the xbox core for just $150, it's going to be mayham over there. ;)

Funny. I talked to lots of people who planned to buy a 360 because they were miffed that their PS2 broke down. Now it looks like the same may be happening to Microsoft.

I'm curious to know weather or not these problems are being caused by careless design or problems with manufacture. Either way, nothing is to say that buyers of Nintendo's and Sony's next generation machines won't experience similar glitches associated with early adopter units.

I think these problems are inevitable, something so new and technical is bound too have its glitches just like any advanced computer system. Except you cant download patches and upgrades here! Of course it sucks when things like this happen, you feel helpless and there is little you can do except sit back and wait for Microsoft to respond! Sad!

I got mine on November 22nd and I haven't had a problem yet. I think it is just a very small, but very vocal minority complaining.

I 'm going to get mine next week hopefully... unless i hear about more problems...

WTF??? They weren't kidding when they said they had bug problems. :eusa_thin

P.S. Sorry if it sounds really dumb but what's wrong with leaving adapters on carpets?

It's not really an adapter. It is actually a power supply like the one in the back of your computer. Since is has to deliver a lot of power to the powerful CPU and graphic card it does get extreamly hot. That is the reason why MS didn't decide to mount it internally in the 360 becasue then it would have been bigger the the heat insiade the cabinett would have been insane.
Since PS3 will be signifigantly powerful then the 360 one can assume that it will also have an external power supply.

I know that... but why can't you put it on the carpet?
By the way, if they put that damn thing inside the Xbox, it would be so much bigger I'm not even joking. The power "brick" for the xbox is about twice as big as my laptop adpator... and it can fry an egg.

A carpet insulates heat pretty good which means that the Ghost buster brick will get even warmer laying on a carpet than on a bare floor. Since it gets pretty hot there is a chance of the carpet catching fire.

Yes it can make a big difference but to be on the safe side, it should be on a bare floor. A week ago I was planning on buying it but now I'm starting to have my doubts and the reason is that there currently isn't any good games to choose from. PGR3 is currently the only game that can puch me into getting the 360. The other games such as Perfect dark Zero and call of duty 2 are terrific but not good enough to make rush out and buy a 360 starter kit for $300-400.

I simply need more time to think about it becasue the 360 isn't cheap at all, especially if you are a student. What about you, have you bought one yet?

Yea I've had mine since the first day it came out... look back to page one or something, I went to camp out at Wallmart for aroud 6 hours, no where as bad as some of the major cities. I think it's definitely worth it because PGR on Xbox live is good fun... and I play Madden as well... Might not be many titles on right now, but they will come.

P.S. I split it 3 ways with my roomates so thats why we were able to get it.

lmao! i bet that one overheats ha...

Yea seriously, I hope that behind that Xbox is the trunk and not the rear seat, because if that's the case, kiss that Xbox goodnight. The air that comes out from behind the box is easily 30 to 40 degrees C. Thats my estimate.
