A regional court in Munich has ruled that the Shuanghuan CEO SUV, a vehicle that shares a striking resemblance to BMW’s X5, is no longer allowed to be sold in Germany. The ruling comes just weeks after Shuanghuan importer, China Automobile Deutschland, launched the new UFO and CEO models in Germany. The importer now has the opportunity to appeal but if it proves unsuccessful dealers will have to return their vehicles.

German court orders importer to destroy Chinese copy of BMW SUV

The importers of the Chinese Shuanghuan CEO sports utility vehicle (SUV) that has a similar appearance to a model made by Germany's BMW must halt all sales and destroy all its vehicles in Germany, a court in Munich ruled Friday, reported dpa.

The court ordered the importers, China Automobile, to pay compensatory damages to BMW, which is based in Munich.

BMW alleges that the Shuanghuan CEO closely resembles its X5.

"We are pleased that the court has agreed with our views," a BMW spokesman said after the ruling.

Karl Schloessl of China Automobile Germany said he would launch an appeal against the ruling, which is not yet binding, saying he was prepared to take the case to the European Court of Justice. It was impossible to ban a vehicle in Germany that was allowed to be on the road in the rest of Europe, Schloessl said, adding that there were more than 1,000 Shuanghuan CEOs on the road in Italy.

He added that the ruling was based on similarities to the BMW X5 dating back to 1998, describing it as "a very old car." Schloessl said the appearance of the vehicle could easily be altered by changing "five or six elements."

BMW has not made clear whether it will seek the compensatory damages awarded by the court.

In the face of protests from German manufacturers, Shuanghuan withdrew its CEO from the Frankfurt IAA international motor show held in September last year.

While on a visit to China in August last year, Chancellor Angela Merkel criticized Chinese carmakers for blatant copies of German makes. Apart from the CEO, Shuanghuan has drawn criticism for its Nobel, which bears a resemblance to Daimler's Smart, an ultra-compact two-seater.
Now it's Mercedes-Benz's turn to sue the shit out of these phony bastards for copying their Smart Fortwo.

Oh and have you in all of your life ever seen anything quite so badly put together?

RUST?! Rust on a brand new car?! Crikey! :t-hair:

Look at that horribly misaligned tailgate... and what's with that piece of plastic on the door sill? LOL!

It's like Merc back in the 90's. :t-banghea

Huh? Are you talking about the poor build quality of that thing above? Are you seriously suggesting that a 1990's Mercedes is just as poorly made as a Chinese car?

Sure... the "Schremp-era" Mercedes (W203, W168, C208, W168, W220) were unreliable, but come on! They were nowhere near as poorly made as the Shuangsomething-or-other BMW X5 rip-off thingy or any other Chinese junkheap for that matter.

This car is so messed up, the front end is from a Toyota Prado, and the rest is from the X5. The steering wheel design is from BMW and the rest of the interior is a copy from the Prado. The car is a genetic disaster.

If you're going to copy a car at least do it right. They should ban it from all countries aside from China. What a POS.

True

the build quality is indeed horrible, but Im pretty confident that the Chinese will become a strong force in the motoring industry within the next 20 years.

I want to know how would any decent German would even think about buying this poorly made sh_tbox? If you want a BMW X5 for a good price, then look at the used car market. Tons of X5's for sale there.

I am glad these copycat bastards got their ass handed to them. And I hope they follow the court order to destroy their useless pieces of crap products. Anyone else thing these guys might just pack up and sell their junk in Eastern Europe?

What a total piece of crap.

It's like Merc back in the 90's. :t-banghea

I took that comment as a joke .....at least I hope you were joking.

Why do the Chinese imitate so much?

I think it can all be put down to Socialism ....and the way it inhibits creativity and individualism.

Historically, the Chinese were among the the most civilized and creative people on earth ..... Communism reduced China to a third world country of imitators producing cheap rubbish.

Things are changing fast .....we might laugh at this hideous SUV, but I am certain, in time, we will see a lot of creativity and genius come out of China again.

I think these big companies in China are just fundamentally dishonest and money hungry and they don't care about any sorts of ethical responsibilities. This imitation stuff doesn't only limit to car manufacturers, there are companies which manufacturer imitation spare parts for cars as well. :t-banghea

^ Despite what some westerners [arrogantly] assume, there is a lot of creativity in China ....some very important contemporary art is coming out of China right now ...and commanding 7 figure sums at auction too.

China is still going through a period where it is obsessed with everything from the west -- I expect this will start to change after a decade or so ....when China will start to establish its own influence on global culture and taste.

Your avatar is moving man....:D

I saw that ceo crap a month ago on the streets and boy what a mutilated vehicle that one is,utter crap on wheels:eusa_doh:

I doubt they really care. It is not like there were going to sell like a zillion of them in Germany or for that matter anywhere outside china.

I have no clue... like most other stuff :D. May be the Chinese thought it is like selling fake Rolex or Chanel No. 5.
